This is a quick walk-through of a Chapter 13 case and what you need to do to be successful.


Consultation Appointment:

Come in and meet with Attorney Marcus Herbert and find out how you can best be helped with your debt problems.

Documents:

A bankruptcy petition requires a lot of information. Just bring us the needed documents and we will prepare your case for you.

Credit Counseling:

The court requires that you take a short credit counseling class and receive a certificate before your case is filed with the court.

Sign Your Chapter 13 Petition:

Come in and meet with Marcus Herbert again to review, make the last minute changes and updates, sign your petition, and get it filed with the court.

Your §341 Meeting of Creditors:

You go to court with your attorney and have a short meeting with the trustee to review your case. Once your Plan is approved, an Order of Confirmation will be entered in your case.

Follow Your Plan:

Make your payments for the required time period and follow all of the details of your Order of Confirmation.

Plan Completion and Discharge:

Once your Plan is certified as complete, the court will order the debts you paid on in your plan discharged.*

Every case is different

Each person's Chapter 13 Plan is based on many factors, including income, assets, and types of debt. Make sure you let Marcus Herbert and your paralegal know everything about your financial situation.

*Some debts cannot be discharged

Congress has determined that certain debts cannot be discharged in a bankruptcy. These include, but are not limited to, domestic support obligations, most student loans, most taxes, and criminal fines.
